The purpose of these Terms and Conditions (“Terms”) is to stipulate the rights, obligations, and responsibilities of the operator of the esimplay online store (“Mall”), operated by Planet T Inc., and the users, in connection with the provision and use of internet-related services (“Services”) via the Mall.
These Terms also apply, to the extent not contrary to their nature, to electronic commerce conducted via PC communications, wireless networks, and similar means.
Article 2 (Definitions)
“Mall” refers to the virtual place of business set up by Planet T Inc. using computer and information communication facilities to sell goods or services (“Products”), and also refers to the operator of that Mall.
“User” refers to any member or non-member who accesses the Mall and uses the Services under these Terms.
“Member” means a User who has registered with the Mall and has ongoing access to Services provided by the Mall.
“Non‑member” means a User who uses Services without registering as a Member.
Article 3 (Display, Explanation, and Amendment of Terms)
The Mall must make the contents of these Terms, company name, representative, business location (including complaint-handling address), telephone number, fax number, email, business registration number, e-commerce registration number, and personal data protection officer’s contact information easily accessible, such as on the initial service screen. Explanatory notices may be accessible through a linked page.
Before agreeing to the Terms, users must be shown important content (e.g. withdrawal/refund conditions) via a separate link or pop-up, and must explicitly confirm their understanding.
Planet T Inc. may amend these Terms to the extent permitted by related laws, including the Consumer Protection Act in E-Commerce, the Act on Regulation of Terms and Conditions, the Electronic Documents and Transactions Act, the Electronic Financial Transactions Act, the Digital Signature Act, the Network Promotion and Protection Act, the Door-to-Door Sales Act, and the Framework Act on Consumers.
When amending Terms, the Mall must post the effective date and reasons along with the current and amended Terms on its initial page at least 7 days before the effective date. If amendments are unfavorable to users, a notice period of at least 30 days is required, and the changes must be clearly compared.
Amendments apply only to contracts concluded after the effective date, unless a member requests and the Mall agrees in writing during the notification period to apply the amended Terms retroactively.
Matters not stipulated in these Terms, or interpretation thereof, shall be governed by relevant laws and Fair Trade Commission guidelines.
Article 4 (Provision and Change of Services)
The Mall provides:
(1) Information on Products and contract formation;
(2) eSIM and USIM data resale mediation;
(3) Ad platform services related to Planet T Inc.’s operations;
(4) Other services designated by the Mall.
The Mall may change, suspend, or discontinue all or part of the Services due to partnerships, declining membership, reduced profitability, technological advances, or operational needs.
Changes or suspensions will be posted in advance, stating details, reasons, and dates, via notice or internal announcements.
If Products are out of stock or specifications change, the Mall will immediately notify users by updating the relevant Product page.
If a contracted Service changes due to stock or specification issues, the Mall will promptly notify the user and compensate for any damages, unless the Mall proves no fault.
Article 5 (Suspension of Services)
The Mall may temporarily suspend Services for maintenance, equipment repairs, malfunctions, or communication failures.
The Mall compensates for damages caused by suspension, except when it proves no intent or negligence.
If Services cannot continue due to business changes (e.g. discontinuation, mergers), the Mall will notify users under Article 8 and compensate as per offered terms or by converting points/mileage into equivalent value.
Article 6 (Membership Registration)
Users apply for membership by completing the registration form and agreeing to these Terms.
The Mall may deny registration for applicants who:
(1) Previously had membership revoked under Article 7(3), unless 3 years have passed and re-registration is approved;
(2) Provided false or incomplete information;
(3) Are technically unsuitable for service.
Registration is completed when the Mall’s approval reaches the user.
Members must update their information without delay when changes occur.
Article 7 (Withdrawal and Disqualification)
Members may withdraw at any time, and the Mall will promptly process their withdrawal.
The Mall may suspend membership for reasons including false information, unpaid fees, interference with Mall operations, illegal use, or actions against public order.
If such behavior recurs twice or is not corrected within 30 days, the Mall may revoke membership.
Before revoking membership, the Mall will notify the member and provide at least 30 days to state their case.
Article 8 (Notifications to Members)
Notifications to members are sent via the agreed email address.
For general announcements, the Mall may replace individual notices by posting on the bulletin board for at least one week, but will individually notify on serious matters relating to a member’s transactions.
Article 9 (Order Placement)
To place an order, Users must:
(1) Select Products;
(2) Enter recipient name, address, phone number, email (or mobile number);
(3) Confirm Terms, withdrawal restrictions, and shipping fees;
(4) Indicate agreement with Terms;
(5) Submit the order and agree to Mall confirmation;
(6) Choose a payment method.
If personal information is provided to third parties, the Mall must disclose the recipient, purpose, data items, and retention period, and obtain consent—even if the information changes afterward.
For outsourced handling, the Mall must notify and obtain consent regarding the delegate and delegated tasks, unless directly necessary for service provision and convenience, in which case disclosure via Privacy Policy suffices.
Article 10 (Contract Formation)
The Mall may refuse an order if it contains false information, involves minors purchasing restricted items, or poses technical issues. Minors require guardian consent, which must be notified.
A contract is formed when the Mall sends an order confirmation as specified in Article 12.
The confirmation must include order verification, availability, and any modification or cancellation terms.
Article 11 (Payment Methods)
Payment may be made via available options such as:
Phone/internet/mail banking
Prepaid/debit/credit cards
Bank transfers
Electronic currency
Cash on delivery
Mall-issued loyalty points
Gift certificates recognized by the Mall
Other electronic payment methods
The Mall may not charge additional fees for payment method choice.
Article 12 (Order Confirmation, Modification, Cancellation)
Upon order placement, the Mall sends a confirmation.
If the confirmation content is incorrect, the user may request modification or cancellation before shipment, and the Mall must comply. If payment has already been made, refund procedures under Article 14 apply.
Article 13 (Delivery of Products)
Unless otherwise agreed, the Mall will ship Products within 7 days of order placement, or within 3 business days after payment. The Mall must enable users to track delivery.
The Mall must disclose the shipping method, costs, and estimated delivery time. The Mall compensates for delivery delays unless no fault is proven.
Article 14 (Withdrawal and Refund)
If Products are out of stock, the Mall will promptly notify the user and refund any payment within 3 business days.
eSIM vouchers or USIM cards may be withdrawn before data plan activation; associated costs are borne by the buyer.
No refund is possible for expired/unused items.
No compensation is provided for eSIM or USIM cards.
Requests due to service issues abroad must be sent before returning to the country and confirmed via customer support; unverified claims after return cannot be refunded.
USIM cards are refundable only for manufacturing defects; issues due to local telecom settings or device incompatibility are non-refundable.
Unopened items before expiry are refundable; prepaid return shipping (≈₩6,000) is borne by the buyer for USIM.
No compensation for delivery delays by courier.
No compensation for unused data.
Refund timing varies depending on telecom carrier verification and credit card company processes.
Other procedures follow applicable laws including consumer protection statutes.
Article 15 (Effects of Withdrawal)
When refunding via credit card or electronic payment, the Mall will promptly request cancellation of the charge.
Return shipping costs shall be borne by the user, but no penalties will be imposed by the Mall except if the Product significantly differs from its description, in which case the Mall covers shipping costs.
The Mall clearly indicates who bears the shipping cost for returned items at the time of withdrawal.
Article 16 (Limitation of Liability)
The Mall is not liable for lost expected profits or damages arising from Service use.
The Mall is not liable for damages caused by infrastructure or telecom provider failure; liability is governed by separate Site Terms.
The Mall is not responsible for user-submitted or transmitted content.
The Mall is not responsible for usage disruptions caused by user negligence.
The Mall is not liable for disputes or content exchanged between users or with third parties.
The Mall is not responsible for the authenticity or accuracy of content provided on the Site.
The Mall is not liable for system failures due to maintenance, force majeure, or cyberattacks not preventable by industry-standard practices.
Barring gross negligence, the Mall is not responsible for damages due to inaccurate user information, user errors during access/use, third-party illegal access, or prevention efforts.
Article 17 (Protection of Personal Information)
The Mall collects only the minimum personal information necessary for service provision.
Pre-contractual identity verification data is collected only as required by law.
The Mall notifies users of purpose and obtains consent upon collection/use of personal data.
Data may not be used beyond the specified purpose, and additional use or provision to third parties requires notice and consent, except as permitted by law.
When obtaining consent, the Mall must provide contact details of the data protection officer, purpose of collection and use, details and duration of third‑party provision, in accordance with Network Promotion and Protection Act. Users may withdraw consent anytime.
Users may access and request correction of their data; the Mall must comply without delay and suspend use until correction.
The Mall limits personnel handling personal data and is responsible for any loss, theft, leakage, or unauthorized alteration of personal data.
The Mall or any recipient must destroy personal data without delay once the purpose is achieved.
Consent checkboxes are not pre-selected, and refusal to consent to non-essential items does not restrict account registration or service access.
Article 18 (Obligations of the Mall)
The Mall shall not engage in illegal or immoral activities and shall continuously and stably provide goods/services as specified in these Terms.
The Mall must implement security systems to protect personal data (including credit information).
The Mall is liable for damages caused by false advertising in violation of the Fair Labeling and Advertising Act.
The Mall will not send unsolicited commercial emails to users.
Article 19 (Member’s Obligations Regarding ID and Password)
Except as specified in Article 17, members are responsible for managing their IDs and passwords.
Members must not allow others to use their login credentials.
If a member’s credentials are stolen or used by a third party, they must notify the Mall immediately and follow instructions.
Article 20 (Prohibited Acts by Users)
Users shall not:
Register false or misleading information;
Use others’ information;
Alter Mall-posted content;
Transmit unauthorized content/software;
Infringe Mall’s or third-party intellectual property rights;
Defame or obstruct business operations;
Post obscene, violent, or otherwise unlawful content.
Article 21 (Affiliated Links Between Malls)
If the Mall includes hyperlinks to external sites (“Linked Mall”), the Mall is deemed the “Connecting Mall” and the linked site the “Connected Mall.”
The Connecting Mall is not liable for transactions between Users and the Connected Mall, provided this is clearly stated on the homepage or a pop-up.
Article 22 (Copyrights and Use Restrictions)
Copyright and intellectual property rights of content created by the Mall belong to the Mall.
Users may not reproduce, transmit, publish, distribute, or commercially use such content without prior consent.
If the Mall uses material owned by a member under agreement, the Mall will notify the member.
Article 23 (Dispute Resolution)
The Mall establishes and operates a dispute resolution and compensation system for user complaints.
Complaints submitted by users are prioritized and handled promptly; users will be informed of delays.
Consumer disputes may be mediated by the Fair Trade Commission or local authorities.
Article 24 (Jurisdiction and Governing Law)
Lawsuits related to e-commerce disputes between the Mall and users are subject to the jurisdiction of the users’ location at the time of filing. If the user's address is unknown or they live abroad, litigation follows the Civil Procedure Act.
Korean law governs all e-commerce related disputes between the Mall and users.
Addendum (Effective Date)
These Terms take effect as of November 1, 2022.
